Terms of Service

These Terms of Service ("Terms") govern your use of the Kuroma platform ("Service"), operated by iKala ("we," "our," or "us"). By accessing or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 16 years old and have the legal capacity to enter into a binding agreement. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration

• You sign in to Kuroma using Google OAuth. You are responsible for maintaining the security of your Google account.
• You must provide accurate information and keep your account details current.
• You are responsible for all activity under your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Service Description

Kuroma is an AI brand visibility platform that:

• Monitors how AI platforms (ChatGPT, Gemini, Claude, Perplexity, Grok, AI Overviews, AI Mode) represent your brand.
• Provides AI readiness assessments, competitive intelligence, and market insights.
• Tracks AI-attributed website traffic via an attribution pixel.
• Integrates with Google Analytics to display total website traffic alongside AI attribution data.
• Generates industry benchmarks from aggregated, anonymized user data.
• Provides automated AI-driven content analysis, fact verification, and grounding.

4. Subscription Tiers & Billing

• Free Tier: 1 brand, limited scans and features. No credit card required. Free forever.
• Paid Tiers (Pro, Business, Enterprise): Additional brands, higher scan limits, advanced features, and priority support. Pricing is listed on our website.
• Paid subscriptions are billed on a monthly basis. You may cancel at any time; cancellation takes effect at the end of the current billing period.
• We reserve the right to change pricing with 30 days' notice.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to access other users' accounts, data, or brands without authorization.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Use automated tools (bots, scrapers) to access the Service outside of our provided APIs.
• Circumvent rate limits, tier restrictions, or usage quotas.
• Submit false, misleading, or malicious brand or competitor data.
• Use the Service to harm, defame, or harass any person or organization.
• Interfere with or disrupt the Service or its infrastructure.

6. Intellectual Property

• Our IP: The Service, including its design, code, algorithms, AI models, templates, and documentation, is owned by iKala and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service.
• Your Data: You retain ownership of the brand data, content, and information you provide to the Service. You grant us a limited license to use this data solely to provide and improve the Service.
• AI-Generated Content: Scan results, AI readiness scores, competitive analyses, and other outputs generated by the Service are provided for your use but do not constitute professional advice.
• Benchmarks: Industry benchmarks are derived from aggregated, anonymized data. No individual user or brand is identifiable in benchmark outputs.

7. Google Analytics Integration

• Connecting Google Analytics is optional. You authorize us to access your GA4 property data via the Google Analytics Data API.
• We use this data solely to display website traffic metrics within your Kuroma dashboard.
• You can disconnect Google Analytics at any time from the Attribution page settings.
• Our use of Google data complies with the Google API Services User Data Policy.

8. Attribution Pixel

• The Kuroma attribution pixel is a lightweight JavaScript snippet you install on your website.
• It detects visitors referred from AI platforms and records anonymized attribution events.
• The pixel does not collect personally identifiable information (PII) from your website visitors.
• You are responsible for disclosing the use of the pixel in your own website's privacy policy.

9. Data & Privacy

Your privacy is important to us. Please review our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

10. Service Availability & Warranties

• We strive to maintain high availability but do not guarantee uninterrupted service. Maintenance windows and outages may occur.
• The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
• AI-generated analyses, scores, and recommendations are informational and should not be relied upon as the sole basis for business decisions.
• We do not guarantee the accuracy of data returned by third-party AI platforms.

11. Limitation of Liability

To the maximum extent permitted by law:

• iKala's total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
• We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities.
• We are not responsible for actions taken by third-party AI platforms regarding your brand representation.

12. Indemnification

You agree to indemnify and hold harmless iKala, its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

• You may delete your account at any time from the Settings page.
• We may suspend or terminate your account for violation of these Terms, with notice when feasible.
• Upon termination, your right to use the Service ceases immediately. We will delete your personal data in accordance with our Privacy Policy.
• Brand data that has been contributed to aggregated benchmarks (anonymized) is not deleted upon account termination.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice in the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of Taiwan (Republic of China). Any disputes shall be resolved in the courts of Taipei, Taiwan.
